Angels Radio AM830 Twitter Sweepstakes Rules

The following terms, conditions, and rules (“Official Rules”) explain and govern the
Angels Radio AM830 Twitter Sweepstakes (“Sweepstakes”) as presented by
LAA 1 LLC dba KLAA AM830 (“AM830” ).

NO PURCHASE NECESSARY TO ENTER OR WIN.

A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. 5 POTENTIAL WINNERS WILL BE SELECTED AT RANDOM. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

SWEEPSTAKES ENTRY PERIOD: Tuesday, June 25, 2019 at 9:00 p.m. PT through Wednesday, June 26, 2019 at 12:00 p.m. PT (the “Sweepstakes Entry Period”).

SWEEPSTAKES DRAWING PERIOD: Wednesday, June 26, 2019 (“Sweepstakes Drawing Period”).

DEFINITIONS:

1. “AM830 Fan Club” means the AM830 e-mail Fan Club from which entrants will receive news, special offers, newsletters, and other correspondence from the Angels and/or, AM830 and/or sponsor.
2. “Angels” or “Designated Team” means the Los Angeles Angels of Anaheim.
3. “Authorized Account Holder” means the natural person assigned to a social media account, such as Twitter or Instagram, or to a phone number by a cell phone provider and an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
4. “MLB” means Major League Baseball, the Office of the Commissioner of Baseball, the American and National Leagues of Professional Baseball Clubs, Major League Baseball Enterprises, Inc., Major League Properties, Inc., Major League Properties Canada, Inc., Baseball Television, Inc. d/b/a Major League Baseball International, MLB Advanced Media, L.P., MLB Advanced Media, Inc., each of their respective successors and assigns or any other entity acting on behalf of the Major League Baseball Clubs collectively.
5. “Released Parties” means Angels Baseball LP, AM830, Feld Motorsports Inc., Angel Stadium of Anaheim, Major League Baseball, the American League, all Sweepstakes sponsors and prize donors, and their respective parent, subsidiary, and affiliate companies, divisions, representatives, agents, suppliers, distributors, and advertising/promotion agencies, as well as each such company’s officers, directors, employees and agents.
6. “Winner” means the eligible Sweepstakes entrant selected via random drawing by AM830. All Winners are subject to verification, including verification of eligibility, and execution of all releases as required by AM830, whose decisions are final and binding in all matters related to the sweepstakes.

I. HOW TO ENTER: To participate in the Sweepstakes, you must have a valid, public (i.e. not “protected”) Twitter account and follow the Official @AngelsRadioKLAA Twitter Account.  Persons must go to Twitter and go to the @AngelsRadioKLAA Twitter page.  From there, locate the twitter post mentioning the instructions on how to win the four (4) tickets to the Angels game on June 26, 2019 and retweet that post on your public Twitter account.  Online entry only.  No other method of entry will be accepted.  Limit one (1) entry per person/Twitter account/email address/household for Sweepstakes.  Additional entries beyond the specified limit will be void.  No multiple entries or the creation of multiple accounts for multiple entries will be accepted.  In case of multiple entries received from any person or Twitter account during an Entry Period, only the first Entry received from such person or account during such Sweepstakes Entry Period will be considered.

To enter and to be considered an eligible entrant, all participants must have a valid, public Twitter account. Only publicly viewable posts on Twitter containing the retweet will be considered valid entries.  All information submitted online via Twitter is subject to, and will be treated in a manner consistent with, the Twitter Terms of Use and Privacy Policy, available at https://twitter.com/en/tos and https://twitter.com/en/privacy.  If you do not have a Twitter account, visit www.twitter.com or download the free Twitter application and register in accordance with the instructions for a free** Twitter Account.  By successfully completing and submitting all of the required information as directed you will be entered into the sweepstakes.  Any Entry that does not comply with the Content Restrictions or otherwise with these Official Rules, are void, eliminated, and will not be eligible for consideration. **Data and usage fees may apply to the download and use of the Twitter application.

By entering into this Sweepstakes, participants will agree to these Official Rules and will be part of the AM830 text and e-mail Fan Clubs.  Participants can be removed from the AM830 Fan Club by following the unsubscribe instructions on future text and/or e-mail messages.  Personal information will be used for marketing and promotional purposes and to contact the selected Winner regarding the Prize.  However, personal information will not be sold to third parties.

Standard Text Messaging rates may apply – check with your cell phone provider regarding possible text messaging or data charges.  AM830 assumes no responsibility for charges incurred for text messaging or data, including, without limitation, as a result of any bounce back messages or Sweepstakes notifications from AM830.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, AM830 WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT, AND AM830, SPONSOR, AND/OR THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY’S FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

AM830, Sponsor, any and all Prize donors, and/or each of their respective subsidiaries and affiliates will not be responsible for printing errors, inaccurate, incomplete, stolen, lost, mutilated, illegible, misdirected, delayed or late entries, telephone or equipment malfunction, unauthorized human intervention, inaccurate capture, or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer transmissions, and/or network connections.  Any entry not actually received for any reason, or entries submitted in a manner not consistent with the requirements of these rules, will be disqualified.  Only one (1) entry per method, per person, per household and per Sweepstakes will be accepted.

No person may enter on behalf of another individual, in another person’s name, or using another individual’s phone number and or e-mail address.  No mechanically reproduced or automated entries permitted.  Any person found in violation of these Official Rules will be disqualified and all entries submitted by that person will be ruled ineligible for any prize award.  In the event of a dispute as to any registration, the Authorized Account Holder of the e-mail address and/or submitted address used to register will be deemed to be the registrant.  All entries become property of AM830 and will not be returned. Decisions regarding any issues or clarification of rules of the Sweepstakes shall be left within the sole discretion of AM830, sponsor, and/or any sweepstakes administrators (if applicable), all decisions of which are final and binding.

EXCEPT FOR THE MEANS DESCRIBED IN THESE OFFICIAL RULES, NO OTHER MEANS OF ENTRY ARE PERMITTED.

II. CONTENT RESTRICTIONS:Entrants must not include any of the following content (the “Content Restrictions”) in any Entry: (a) pornography, adult-oriented content or any other sexually-explicit material; (b) materials relating to lotteries or gambling; (c) explicit language or content, images of violence, or promotion of illegal activities; (d) content in violation of intellectual property rights or laws; (e) libelous, defamatory, disparaging, tortious or slanderous materials; (f) content that denigrates, disparages or reflects negatively on the MLB Entities, their owners and employees, or the game of baseball; (g) tobacco, alcohol or drugs; (h) dangerous stunts; (i) real weapons of any kind including, but not limited to, guns, knives or projectiles; (j) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state or local law, ordinance, or regulation; (k) individuals under legal age of majority without providing a signed release from parent or legal guardian; (l) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (m) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any state where the Entry is created. Any Entry that does not comply with the foregoing, in the sole discretion of AM830, will be disqualified.

III. ELIGIBLE PARTICIPANTS:  Sweepstakes is open to all persons age 18 and over as of the date of entry with a valid and original DMV driver’s license or identification card, who are legal residents of the State of California, who reside within the broadcast listening area of AM830 and otherwise qualify in accordance with these Official Rules.  Furthermore, people who are either (1) directors, officers, employees, representatives, or agents (as well as the family and household members of any of the preceding persons of AM830, Angels Baseball LP, Major League Baseball, or any of its teams or member organizations, contractors working for Twitter, AM830, the City of Anaheim, AEG, News Corp, any advertising and promotional agencies, any Sweepstakes sponsor, any prize donor, or any media and press entities, or (2) are otherwise involved with Sweepstakes, as well as respective parents, divisions, subsidiaries, affiliates, successors, and assignees of each of the preceding categories of people and entities, shall be ineligible to participate in the Sweepstakes and shall be ineligible to win any prize covered herein.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY AM830, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.  AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY IS VERIFIED, AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE

IV. PRIZE / ODDS OF WINNING:  Actual odds of winning are based upon the total number of entries received. Prize is provided “as is.”  No prize substitutions will be permitted. No exceptions.

V. WINNER SELECTION, NOTIFICATION AND REDEMPTION:  During the Sweepstakes Drawing Period, AM830 shall conduct five (5) random drawings from all the eligible entries received.  In the event any winner selected is determined or confirmed not to meet the eligibility requirements, or does not wish to participate in the Sweepstakes, then AM830 reserves the right to randomly select and determine another Winner (time permitting) from all eligible entries received. Five (5) potential qualifying winners of the Sweepstakes will be selected during the Sweepstakes Drawing Period.

AM830 may, at their sole discretion, attempt to contact any potential winner via their Twitter profile or, if available, by phone or e-mail, to notify the entrant of their selection as a winner for the Sweepstakes.   The potential Winner will then be required to respond to the notification within twenty-four (24) hours of the notification and indicate whether or not the potential winner can accept the prize.  If no response is received within the time allotted, or if a selected potential winner cannot be contacted, is ineligible, does not wish to sign the affidavit or required forms as dictated by AM830 in its sole discretion, or does not claim the prize, then the winner forfeits this prize and an alternate potential winner will be randomly selected.

Any potential winner who does not meet the eligibility requirements, or does not wish to participate in the Sweepstakes will be disqualified. An alternate potential winner will then be randomly selected per the procedures outlined below.

VI. PRIZE DETAILS: 
Five (5) winners will be selected at random.  Each winner will receive four (4) Left Field Pavilion Tickets to the Angels vs. Cincinnati Reds game on Wednesday, June 26, 2019 at Angel Stadium in Anaheim, CA (each a “Prize”).
(Each 4-pack of tickets ARV:  $76).

The selected Winner(s) must accept delivery of prizes from AM830 as instructed by AM830.  THE SELECTED WINNERS ARE SOLELY AND ENTIRELY RESPONSIBLE FOR ANY AND ALL APPLICABLE FEDERAL, STATE AND LOCAL TAXES, TITLE, LICENSES AND REGISTRATIONS INVOLVING THEIR PRIZE, AS WELL AS ANY AND ALL COSTS AND EXPENSES NOT EXPRESSLY SPECIFIED HEREIN RELATED TO THE PRIZE, INCLDING (WITHOUT LIMITATION) THE COST TO OPERATE AND INSURE THEIR PRIZE.  IN THE EVENT THE PRIZE REQUIRES TRAVEL, TRAVEL EXPENSES NOT MENTIONED OR NOT INCLUDED ARE THE SOLE RESPONSIBILITY OF THE WINNER.  ALL EXPENSES AND INCIDENTAL TRAVEL COSTS NOT EXPRESSLY STATE   ALL OTHER COSTS RELATED TO PRIZE DELIVERY AND ACCEPTANCE ARE THE RESPONSIBILITY OF PRIZE WINNER, INCLUDING BUT NOT LIMITED TO FEDERAL, STATE AND LOCAL TAXES.  All properly claimed prizes will be awarded. Prizes are non-transferable and no cash redemption or prize substitution is allowed, except in AM830’s sole discretion or as provided herein.  AM830 reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. The Prize will be awarded to a maximum of five (5) selected Winner(s) during the Sweepstakes. The Sweepstakes is immediately concluded following the awarding of five (5) eligible prizes.

VII. THE APPROXIMATE RETAIL VALUE:

THE APPROXIMATE RETAIL VALUE OF EACH PRIZE: $76. Winner(s) may be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release, and present a valid driver’s license within the time period directed by AM830 before a prize will be awarded.  Winners of prizes valued at more than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s).  Failure to collect or properly claim any prize in accordance with these Official Rules will result in forfeiture of the prize.  If forfeited for any reason, Winner will not receive any other prize substitution or compensation.  Total ARV of all prizes available: $380 ($76.00 each Prize).

VIII. ALL PRIZES GENERALLY: 
The Winner is solely and entirely responsible for any and all applicable federal, state and local taxes, title, licenses, and registrations involving their prize, as well as any and all costs and expenses not expressly specified herein related to the prize, including (without limitation) the cost to operate and insure their prize.  In the event the prize requires travel, travel expenses not mentioned or not included are the sole responsibility of the Winner. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes, or other expenses are the sole responsibility of the Winner. Trips are non refundable.

No substitution will be made except as provided herein at AM830’s sole discretion.  AM830 reserves the right to substitute a prize for one of equal or greater value if the Prize should become unavailable for any reason.  NO PRIZE OR CASH SUBSTITUTIONS WILL BE PERMITTED.  PRIZES ARE NOT TRANSFERABLE AT ANY LEVEL AND ARE NOT ASSIGNABLE.

Each entrant in the Sweepstakes understands and accepts that the depiction of a prize in any advertising or promotional materials may not reflect the actual prize to be delivered to the Winner. By entering, each entrant agrees that if selected as a Winner, such entrant will sign a release and waiver of liability and a publicity release and authorization. Prizes that are not claimed as instructed by AM830 will be forfeited and may be awarded to another entrant if: (i) the selected Winner does not execute the proper forms of documentation by said deadline, (ii) the selected Winner is not eligible in accordance with the Official Rules, (iii) the Official Rules are violated, or (iv) Sweepstakes is cancelled or not held.

Prizes may be claimed during normal business hours at the AM830 Administration Office located at 2000 E. Gene Autry Way, Anaheim CA 92806 or at such other reasonable location, date, and time as specified by the AM830. AM830 and/or the Sweepstakes Sponsor shall not be responsible for any delay in delivery of a prize to the Winner, although it will use its commercially reasonable efforts to arrange delivery. The Winner shall bare all risk of loss or damage to the prize after it has been delivered to the Winner.  Winner must show original and acceptable valid identification documentation to AM830 or its designees before receiving the prize.

IX. CONDITIONS TO ENTRY AND OTHER GENERAL RULES: 
Each Sweepstakes entrant acknowledges and agrees, to the maximum extent permitted by law, that the Released Parties will have no liability whatsoever for any injuries, losses, harm, damages, claims, causes of action or liability, including, but not limited to, personal injury, death, or damage to or loss of property, of any kind resulting from awarding, receipt, acceptance, possession, use or misuse of any prize, or from the participation of entrant in Sweepstakes, including (without limitation) for the awarding or reimbursement of any prize otherwise payable to an entrant who is ineligible. The Winner acknowledges that no release has been made or any warranty, representation, or guarantee, whether expressed or implied, regarding any prize and agrees that the Released Parties, to the maximum extent permitted by law, disclaim all warranties, express or implied, including (without limitation) those of merchantability, quality, mechanical condition and fitness for a particular purpose. To the maximum extent permitted by law, each entrant and the Winner agrees to indemnify and hold harmless each Released Party against any and all claims, suits, damages, losses, liabilities, obligations, fines, penalties, costs and expenses (based on any and all possible theories), including reasonable legal fees and expenses in connection with the prize provided or arising from or in connection with their participation in Sweepstakes.

By entering, each entrant grants permission, without further compensation to any sponsor, AM830 KLAA, Angels Baseball LP, and/or the agents and licensees of each such entity, to (1) add entrant to the AM830 Fan Club (2) contact entrant by any means, including text and email regarding Sweepstakes or any other promotional, marketing, sales or other business activity of the contacting entity, and (3) to use, record, perform, reproduce and display the entrant’s name, voice, photograph, likeness, and biographical material in any medium in perpetuity throughout the known universe for historical, advertising, marketing, publicity, broadcast or other promotional purposes in connection with the Sweepstakes or the business and operations of AM830 and such contacting entity. Entrant further grants permission to all sponsors, AM830 KLAA, Angels Baseball LP, and the agents and licensees of each such entity, to sublicense, transfer, and share all or any of the preceding rights, information and material and acknowledges that all information and materials shared will not be private.

X. COMPLIANCE WITH RULES:
By participating in Sweepstakes, each entrant agrees to be bound by the Official Rules and the rules and decisions of AM830, and Angels Baseball LP which shall be final. AM830 reserves the right to cancel Sweepstakes, whether in whole or in part, including (without limitation) the occurrence of any force majeure event such as a fire, earthquake, flood, storm, other act of nature or God, war, riot, civil disturbance, terrorist act, strike, work stoppage, etc. Failure to meet and comply with the Official Rules will result in immediate disqualification and the forfeiting of this and any prize awarded. No Exceptions.

Sweepstakes is void where prohibited by law and is subject to all applicable federal, state, and local laws.  Sweepstakes shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules.  Any court of competent jurisdiction sitting within Orange County in the State of California will be the exclusive jurisdiction and venue for any dispute arising out of or relating to Sweepstakes or the Official Rules thereof.  In the event that any legal or regulatory authority challenges AM830 or the Sweepstakes, AM830 reserves the right to discontinue or modify the Sweepstakes or to disqualify ineligible entrants.  AM830 will not have any liability to any entrants are disqualified due to such an action.

XI. AMENDMENTS:
These Official Rules, along with Sweepstakes eligibility, performance, participation, and prize awarding, are subject to the interpretation, rules, modifications, and decisions of AM830, Angels Baseball, or Sponsor, who reserve the right to revise, change, suspend or discontinue any aspect of the Sweepstakes at any time without claim for damage or recourse of any kind.  The Official Rules may be amended at any time by posting the Amended Official Rules on www.am830klaa.net. The Amended Official Rules shall be effective immediately upon posting to www.am830klaa.net, or as indicated in the Amended Official Rules.

XII. GENERAL CONDITIONS: 
AM830 reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, or any other factor beyond AM830 reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by AM830 in its sole discretion. In such event, AM830 reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. AM830 reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, AM830 reserves the right to seek damages from any such person to the fullest extent permitted by law. AM830 failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

XIII. LIMITATIONS OF LIABILITY: 
The Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.

If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason.  AM830, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.  No more than the stated number of prizes will be awarded.

XIV. DISPUTES: 
Except where prohibited, entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, (ii) any and all claims, judgments and awards against AM830 shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Sweepstakes is void where prohibited by law and is subject to all applicable federal, state, and local laws. Sweepstakes shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules.  Any court of competent jurisdiction sitting within the State of California, Orange County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to Sweepstakes or the Official Rules. In the event that any legal or regulatory authority challenges or the Sweepstakes, AM830 reserves the right to discontinue or modify the Sweepstakes or to disqualify ineligible entrants.  AM830 will not have any liability to any entrants who are disqualified due to such an action.  Neither Major League Baseball, nor the American League is a sponsor of the Sweepstakes
